Welcome to Traders E Hub. These Terms & Conditions govern your access to and use of the Traders E Hub website, mobile application, and related services. By creating an account, accessing, or using the Platform, you agree to be legally bound by these Terms.

1. Platform Status

Traders E Hub is solely a technology platform that facilitates communication and business interactions between independent buyers and sellers.

IMPORTANT:

Traders E Hub is NOT a seller, manufacturer, distributor, reseller, logistics provider, courier, payment processor, agent, broker, importer, exporter, or guarantor of any transaction conducted through the Platform.

Traders E Hub does not:

Own products listed by sellers.
Inspect or verify product quality.
Guarantee legality of products.
Guarantee seller performance.
Guarantee buyer purchases.
Provide product warranties.
Guarantee delivery timelines.

2. User Eligibility

You must be at least 18 years old and legally capable of entering binding agreements under applicable law.

You are responsible for ensuring all information submitted to the Platform is accurate and current.

3. Account Responsibility

You are responsible for maintaining the confidentiality of your login credentials and all activities performed through your account.

You agree to immediately notify Traders E Hub of any unauthorized use of your account.

4. User Obligations

Users agree that they will not:

Violate any applicable laws.
Post false or misleading information.
Upload illegal products.
Infringe intellectual property rights.
Attempt to hack, disrupt, or interfere with the Platform.
Upload malicious software.
Misrepresent themselves or their business.

5. Seller Responsibilities

Each seller represents and warrants that:

They legally own or are authorized to sell listed products.
All required licenses and registrations are obtained.
Products comply with applicable laws.
Product descriptions are accurate.
Pricing is accurate.
Applicable taxes are properly handled.

Sellers are solely responsible for product quality, safety, warranties, recalls, defects, legal compliance, and consumer complaints.

6. Buyer Responsibilities

Buyers are responsible for independently evaluating products, sellers, pricing, and suitability before purchasing.

All purchase decisions are made entirely at the buyer's own discretion and risk.

7. No Liability for Transactions

ALL TRANSACTIONS OCCUR SOLELY BETWEEN BUYERS AND SELLERS.

Traders E Hub shall not be liable for:

Product defects.
Delivery delays.
Wrong deliveries.
Non-delivery.
Refund disputes.
Payment disputes.
Seller misconduct.
Buyer misconduct.
Fraudulent transactions.
Third-party actions.

8. No Warranty

The Platform is provided strictly on an "AS IS" and "AS AVAILABLE" basis.

Traders E Hub makes no warranties regarding:

Availability.
Accuracy.
Reliability.
Performance.
Security.
Merchantability.
Fitness for a particular purpose.

9. Indemnification

Users agree to indemnify, defend, and hold harmless Traders E Hub, its owners, employees, affiliates, contractors, representatives, successors, and assigns from any claims, losses, liabilities, damages, penalties, judgments, expenses, or legal fees arising from:

Use of the Platform.
Products listed by sellers.
Transactions between users.
Violation of these Terms.
Violation of applicable laws.
Intellectual property claims.
Consumer complaints.
Injury, death, or property damage caused by products.

10. Intellectual Property

All trademarks, logos, software, graphics, designs, and content associated with Traders E Hub remain the exclusive property of Traders E Hub unless otherwise stated.

Unauthorized copying, reproduction, distribution, or modification is prohibited.

11. Content Removal & Account Suspension

Traders E Hub reserves the unrestricted right to:

Remove listings.
Remove content.
Suspend accounts.
Terminate access.
Investigate violations.
Cooperate with law enforcement.

Such actions may be taken without prior notice.

12. Privacy & Data Protection

Use of the Platform is also governed by the Privacy Policy.

Users consent to collection, processing, storage, and use of information as described therein and in accordance with applicable Indian laws.

13. Force Majeure

Traders E Hub shall not be liable for delays or failures caused by events beyond reasonable control including:

Natural disasters.
Government actions.
Internet failures.
Power outages.
Cyberattacks.
War.
Pandemics.
Labor disputes.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRADERS E HUB SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES.

This includes loss of:

Profits.
Revenue.
Business.
Data.
Goodwill.
Reputation.
Opportunities.

The total liability of Traders E Hub shall not exceed ₹10,000 or the total fees paid to Traders E Hub during the preceding six months, whichever is lower.

15. Governing Law & Arbitration

These Terms shall be governed by the laws of India.

Any dispute arising from use of the Platform shall first be attempted to be resolved amicably.

If unresolved, disputes shall be settled through binding arbitration under the Arbitration and Conciliation Act, 1996.

The seat of arbitration shall be Kerala, India, and proceedings shall be conducted in English.

16. Changes to Terms

Traders E Hub may modify these Terms at any time.

Continued use of the Platform after modifications constitutes acceptance of the revised Terms.
